Speaking to Radio.com about the controversy, McKagan seems startled by the similarities. "A friend of mine just sent me that video. It is pretty stunning," he admits. "But we didn't steal it from them! I swear [puts his hand on his heart], I never heard that song until a couple of days ago."

I guarantee James Reyne (frontman of Australian Crawl and one of the two writers on "Unpublished Critics") has tried this already. He's notoriously litigious here in Australia.

axl worked at a record store before GNR. they sold imports. He had to have heard it. You can basically put the songs on top of each other and its the same chords and movements, break down and vocal phrasing other than Slash's intro. The lead singer of UC said before its real close to his song but he doesn't have axle's money to sue him so its a compliment.

Lawsuit.... for what?

It's a 5-4-1 in D.

You can't sue someone for writing a 5-4-1 with a similar rhythm part.

They were, and still are much loved down here.
Never saw them, I was not quite old enough for pub gigs when they were around.
They had some great tunes though.
The guitarist died unexpectedly, cancer I think, and they broke up.
