NYPD's defense is that the protestors didn't have a permit and they refused to disperse. The broader constitutional issue is if a permit defines whether a protest is peaceful or not, thus giving the state power to suppress them. My opinion is that the protest was peaceful and that the permit's power is subordinate to First Amendment protections. If suits are filed in this case and it makes it's way to SCOTUS, the Roberts court would overwhelmingly rule in favor of the protesters.
Lawrence O'Donnell's comparison of this incident with the Rodney King/LA Riots is ludicrous from a Democratic prospective but makes sense from a Marxist perspective. That's why listening to him talk about constitutional issues is like listening to Lady Gaga instruct fathers on how to raise their sons.
