Canseco plans to sue MLB and union over steroids

NEW YORK (AP)—Jose Canseco plans to file a class-action lawsuit against Major League Baseball and the players’ association, saying he’s been ostracized for going public with tales of steroids use in the sport.

Canseco said Wednesday that he has discussed the suit with lawyers and intends to enlist Sammy Sosa(notes) and Rafael Palmeiro to join in the suit.

Canseco said the basis of the suit would be “lost wages—in some cases, defamation of character.”

“Because I used steroids and I came out with a book, I was kicked out of the game, but I have not been inducted into the Hall of Fame,” Canseco said in a telephone interview.

“A lot of these players have not been inducted into the Hall of Fame: Mark McGwire and so forth. They’re losing salaries, because obviously when you’re inducted into the Hall of Fame, you get asked to do certain, you know, appearances and shows and so forth, which incorporates income. So there is a major income loss.

“Not even that, baseball blackballs you from their family, meaning you can’t have a future proper reference from them, a job, no managerial jobs, no coaching jobs, nothing. They completely sever you.”

The 1986 AL Rookie of the Year and 1988 AL MVP, Canseco hit 462 home runs from 1985-2001 and currently is 32nd on the career list. In books published in 2005 and last year, he detailed steroids use by himself and others.

Whether a judge would think Canseco has a case—and would even allow it to go to a jury—remains to be seen.

He appeared on the Hall of Fame ballot in 2007 and received just six votes, 21 below the amount necessary to remain in the Baseball Writers’ Association of America ballot in future years. McGwire, eighth on the career list with 583 homers, received 118 Hall of Fame votes this year, which came to 21.9 percent. That’s well below the 75 percent threshold needed for election and down from 128 votes in each of his first two appearances on the ballot.

“Always, one individual has to make that stand, which is me,” Canseco said. “And then I’ll obviously speak to other players and other individuals, see how far they want to go.”

Rob Manfred, MLB’s executive vice president for labor relations, declined comment. Michael Weiner, the union’s general counsel, did not respond to an e-mail seeking comment.

Canseco said players shouldn’t be stigmatized for using steroids before players and owners agreed to ban them in 2002.

“I don’t see why people just don’t get it. I don’t understand the ignorance,” he said. “Listen: It was allowed by Major League Baseball. It was endorsed by Major League Baseball. Why should the players be now reprimanded?”

He wasn’t surprised by a report Tuesday by The New York Times that Sammy Sosa was among 104 players who tested positive in baseball’s anonymous 2003 survey. The paper cited lawyers with knowledge of the 2003 drug-testing results who spoke on condition of anonymity because they did not want to publicly discuss material under court seal.

“Like I’ve said all along, in my era 80 percent of the players were using steroids and why would Sammy Sosa be excluded from that?” Canseco said. “I think people are going to be amazed how, you know, extensive that list is that Major League Baseball is holding back right now and who are on it.”

Canseco said the list should remain private because players were promised anonymity, but he predicted the remaining names eventually will trickle out and become public.

Maybe I should sue Canseco and McGwire for lost earnings due to their rookie card values plummeting when it was revealed they were on the juice.

For anybody here that subscribed to the MLB EI package like I have, just noticed
the upcoming Sunday Yankees gave vs the marlins at 5 eastern,2 pacific is NOT on the schedule.
Does ESPN have some sort of control over any Sunday games that begin after 4 eastern, 1 pacific?

Probably.

A lot like FOX rules Saturday baseball. Or WEGN always broadcasts the Chicago games, even if they're on the MLB EI listings.

I came across this and wanted to get some opinions on it.

There is some growing animosity between Posada behind the plate, and the MFY pitchers.

The last outing by Joba Chamberlain was almost embarrassing, with the 23-year-old fireballer continually shaking Posada off and wanting to throw his own pitches and the veteran catcher stomping to the mound to confront Joba about pitch selection.

In last night's game Yankee commentators, Michael Kay and John Flaherty, talked at some length about the disrespect that has been shown to Posada. Kay in particular took exception to Joba Chamberlain making such an issue of Posada's pitch selection.

One unsettling fact for the Yankees is the difference when Jorge Posada catches. With Posada behind the plate, the Yankees’ pitchers have a 6.31 E.R.A. The combined E.R.A. with Francisco Cervelli, Jose Molina and Kevin Cash is 3.81...

Burnett, in particular, seems to struggle with him. In Burnett’s four starts pitching to Posada, opponents have batted .330. In nine starts with the other catchers, the average is .223.

Good post. I was unable to see the game last night, so I missed the comments on YES :(
Posada had a run in with another great Yankees pitcher, El Duque.
This sort of thing happens. What can you do?

I saw the game w/Joba on the mound and I was getting very irritated that they were not on the same page.
Posada has said recently that he "suggests what pitch to throw" and the pitcher can either nod yes or shake him off.

As for Joba, the kid is so young and is still getting his feet wet. He might be able to learn something from Posada.

A.J. is another story. If for any reason he does not feel comfortable, then let someone else catch him during the season.

I just think it was interesting. I seem to have been hearing this a lot over the last couple of seasons, but didn't think anything of it. Now it's starting to come up again.

Aside from Mussina this is new though. I seem to recall ( during the Dynasty days ) that Pettitte swore by Jorge behind the plate. Same wtih Clemens, Wells, and Cone. I'm curious now as to the change. Sure he's coming off a surgery, but that shouldn't effect his game calling skills. Granted the MFY rotation hasn't been too good the last few years. Still ( I believe it was Posada, but am too lazy to look it up right now ) he's caught two perfect games with Wells and Cone, and a one hitter with Hughes.

We haven't had a press release about how they are all best buddies in a bit. I wonder what's going on.

If other pitchers just don't get along with him, I don't think it's fair to blame the pitcher or Jorge.
About the perfect games, pretty sure it's not 2.

Joba is starting to sound like AJ was during his tenure here, always shaking off the catchers and throwing the heat, and then the batters would go the fuck off on him. Don't listen to your catcher and coaches, you know everything! Asshole.

I love the fact that Joba's fatass doesn't listen to anyone. I love seeing him take the loss for not.

So how about this new Dontrelle Willis shit?

On the DL for anxiety last year, rehabs in the minors, comes back, is relatively successful. Starts to get bombed in the majors, back on the DL for anxiety. Weird.

I am not passing judgment, because I suffer from anxiety myself - this just seems like a questionable use of the disabled list.

Even Dontrelle himself was saying all his problems were mechanical, and not mental - the trainer was saying otherwise.

Thoughts?

Besides, after having a ball doink off his head for a home run then slumming around with madonna did he have any character left?

I don't get it.

I think that the team is just trying to make something up to get him out of the rotation. Like a phantom-injury. The Player's Union won't let them just sit a guy without "just cause". If that were the case, all players that suck would be sitting, or ones with incentives that the team don't want to pay.

If a player is out of options ( or a vet ). They can't just send them down without the player's consent. I looked into this about what Boston could do to WBC MVP Matsuzaka. Hopefully he suffers from anxiety too. :lol:

Changing subjects, Cliff Lee is probably trashing his locker room right now. ANOTHER quality start blown by the bullpen. You turn over a 7-2 lead in the 7th inning you're pretty sure you have the win, right? He got some run support for a change and he STILL can't catch a break.

So yeah...I HATE THE MFY. Andy was vintage Pettitte tonight, we got 3 freaking hits. Poor West, that was fucking batting practice out there early on. At least the bullpen kept the score from getting out of control.

I don't know what the hell was going on on the Turnpike, but it took us TWO HOURS to get to the ballpark, whereas it usually takes about an hour. Backed up for at least 15 miles, my car was starting to overheat, so we had to get off and get back on somewhere else. MFY Nation was out in full force, and some of the more obnoxious fucks were kicked out. :) They behaved for the most part, just did their obnoxious chants, and went into "Boston Sucks" at one point. :roll:

Oh yeah, ARod sat out tonite and will tomorrow, poor widdle baby is TIRED. WAHHH.

So my throat hurts, my voice is froggy, my ears are ringing, and I had one of the most fun times I've had at the ballpark. I KNEW this pitching matchup would be a dream.

46,427 there tonight, 3rd largest crowd ever for a regular season game. And my Lemmy was it LOUD! Between all the screaming and yelling and the COW BELLS that was the giveaway, you couldn't hear yourself think! Had a fucking blast though, what an awesome game. :D :D :D

Tomorrow...Volstad and CC. If Chris doesn't get his shit together like NOW, it's gonna be a fucking home run derby. :x LET'S GO FISH AND TAKE THIS SERIES!!!!!!!!!!!!!

They have a team that could surpass their Pythag, not unlike the Wild Card contenders of 2007. If Aardsma handles the closer role, Morrow is fine with converting back to a starter, Beltre continues to hit, and Bedard can limit his DL stints. It's possible. Wakamatsu IMO is a decent manager, and they are trying to rebuild with the analysis of Tom Tango.

I'm not sure how I feel about their draft picks yet ( they had like 4 high picks ). A lot of infielders with high defensive projections. No Hernandez's or Arod types waiting in the wings so far.......yet that shit pans out so rarely anyway so whatever.

Goes to show ya Jakey, money can't buy you everything. :P

So yeah, fucking Lindstrom tried to give the game away, but apparently Jeter didn't want it bad enough! That got too close to my comfort, I didn't even see the last out, my hands were over my eyes. I wasn't expecting to take this game, but aside from Volstad's minor meltdown in the 3rd, he pitched a nice game, and the bullpen did their thing.
Was kind of bummed to see CC go so quickly, I was beginning to like him! :) We all thought it was because of the heat and him being a big guy he wasn't used to it, because it was fucking brutally hot and humid.

Another big crowd today, 35,000+. And I have to tip my hat to the MFY fans, by and large they behaved themselves. :shock:


One more thing...Mets and Phillies...see us in your rear view mirror? OBJECTS IN MIRROR ARE CLOSER THAN THEY APPEAR!!!!! We're coming at ya, bitches! :twisted: :twisted: :twisted:

I didn't get to see yesterday's games or today's. I just saw that CC left on Bottomline. I was wondering if something like this could've happened. The guy is a workhorse, but he's been rode harder than a 2$ whore.

Using Baseball Prospectus Pitcher Abuse Points, it points to something like this occuring. I'm not sure if it was his weight and the heat, or the after-effects of last season. I kinda worry about Jon Lester and his massive jump in innings pitched last season, plus Pappelbon's comments about starting to wear down at the end of the year too.

It's all a gamble. That said it's all specualtion and could be nothing.

I wanted to see the matchups. I wanted to see Lowe's return to Fenway. He was one of the "25", yada yada yada. I wanted to see AJ ( not an ace ) Burnett matchup against his former team. I love pitcher's duels. Plus Since 2003 to my recollection, Atlanta has always fucked up the Mighty Red Sox in Inter-League. I like how the boys are playing right now. A Nick Green walkoff? Are you fucking kidding me? :lol:

Same thing happens to the Angels all the goddamn time. Fuck, they beat Lincecum and ended his hot streak, but if you throw Johnny Neverheardofya on the mound against them they'll be lucky to score two runs.
